This is a new age – where technology and science rule the day. Today’s Homicide defense attorney must be prepared to deal with difficult forensic and other issues that are beyond the province of most other attorneys. • Gunshot residue
  • Gunpowder and propellant residue
  • Gunshot residue pattern analysis
  • Blood stain pattern analysis
  • DNA analysis
  • Fingerprint evidence
  • Ballistics evidence
  • Organic chemistry
  • Crime scene reconstruction
  • Serological evidence

Moreover, in homicide and other violent crime cases in New York State, there are a number of legal defenses and other critical issues that tend to arise with regularity. We’ve been involved with murder, attempted murder and assault cases for four decades and have dealt with it all during this time. We are always well-prepared to confront any evidence that a prosecutor may attempt to utilize, and to aggressively investigate all defenses that may lead to your exoneration. This Includes:

  • Experience in asserting a “justification” or self-defense defense under New York State Law
  • Experience in asserting the so-called “insanity” defense under New York State Law
  • Experience in asserting a duress defense under New York State Law
  • Experience challenging the testimony of forensic experts used by the State

At Gaines, Novick, Ponzini, Cossu & Venditti, LLP LLP, we have substantial experience crafting effective defense strategies to help protect our clients’rights when charged with a violent crime. For example, if you have been convicted with first degree murder, certain second degree murders or aggravated murder, you could face one of the following punishments:

  • Death penalty
  • Life imprisonment without parole
  • Between 15-25 years imprisonment

Other types of homicide charges include:

  • Manslaughter in the second degree – you could be charged if you recklessly cause the death of another person or if you intentionally assist/cause someone to commit suicide.
  • Manslaughter in the first degree – you could be charged if you intend to cause serious physical injury to a person and it results in the death of that person (and other circumstances).
  • Vehicular manslaughter in the second degree – you can be charged by this if you break various traffic laws resulting in the death of another person or if you were unlawfully intoxicated/medicated/under the influence of drugs and your behavior resulted in the death of another person.
  • Vehicular manslaughter in the first degree – you can be charged with this if you commit the same actions as vehicular manslaughter in the second degree but with a suspended/revoked driver’s license.
  • Criminally negligent homicide – you can be charged with this if your criminal negligence caused the death of another person.
  • Aggravated criminally negligent homicide – you can be charged with this if your criminal negligence resulted in the death of a peace officer/police officer when he or she was performing official duties.
  • Murder in the second degree – can be charged if you intended to cause the death of another person and you did cause their death, but it can be proven that you were emotionally disturbed, or various other circumstances were present.
  • Murder in the first degree – can be charged if you intend to cause the death of someone and you do cause the death of someone and various different circumstances were present.

There are significant changes in the interpretation of the homicide law that are ongoing. For example, the crime of Vehicular Manslaughter in the Second Degree is a D Felony and occurs when a person is killed as a result of contact with a motor vehicle and the person driving the vehicle under the influence of alcohol or drugs or was operating the motor vehicle recklessly or negligently. Now District attorneys are charging people with Murder with what would otherwise be a vehicular manslaughter charge. Specifically, your New York Homicide lawyer will tell you that the Nassau County District Attorney is now prosecuting people for murder who would otherwise have been charged with DWI when a death occurs. Most importantly, the District Attorney has been getting convictions and this puts the defendants at risk for many more years in prison.
